John has been practicing law for over 20 years. His practice focuses on a broad
range of health law matters with an emphasis on issues concerning acute care and
long-term care facilities. As a frequent speaker to health care organizations,
John is recognized for his extensive knowledge of health care legal matters. He
advises his clients on areas including Medicare and Medicaid reimbursement,
corporate compliance plans, HIPAA, Stark compliance, fraud and abuse issues,
certificate of need, sale and acquisition of health care facilities and
practices, licensure and certification matters, and personnel issues. John
frequently speaks and writes on the countless legal issues faced by the health
care industry.
REPRESENTATIVE MATTERS
Non-profit Hospital Conversion. Worked on a certificate of
need and conversion application process as part of client's acquisition of a
major non-profit health system and its conversion to a for profit status. This
was only the second non-profit hospital conversion in the state of Washington.
Life Care Centers of America, Inc. et al. v. DSHS Successful
challenge to the State of Washington's calculation of the inflation adjustment
for nursing facility medicaid rates. The judgement in this case resulted in an
award to my client of approximately $6 million. Similar relief was later
extended to all nursing facilities in the State of Washington.
Regency Pacific, Inc., et al. v. DSHS. Counsel for a class of
approximately 300 nursing facilities that challenged the Medicaid agency's
calculation of the case mix index used to determine facility Medicaid payments.
This action resulted in a $15 million lump-sum settlement to the class, together
with a prospective change in the Department's practice of determining Medacaid
eligibility for nursing facility residents.
Allenmore Pharmacy, Inc. v. DSHS. Served as co-counsel for the
plaintiffs in a 2000-member class action suit against the State of Washington
Medicaid program for inadequate reimbursement to Medicaid-participating
pharmacies. Resulted in a settlement in the amount of $11 million.
Valley Hospital Ass’n v. State of Alaska, 116 P.3d 580 (Alaska 2005).
Represented Hospital in case where the Supreme Court of the State of Alaska held
that the Medicaid agency had violated the hospital’s procedural due process
rights when applying a new regulation to set the hospital's rates.
In re Charter North Behavioral Hospital. Medicaid rate appeals
addressing complex reimbursement issues. Resulted in additional Medicaid
payments to the appellant facility of $4.5 million.
Alaska Medicaid Fraud Audit. Represented an acute care
facility charged with Medicaid fraud. The State of Alaska Medicaid Program
demanded that the facility pay $1.8 million together with investigative costs
and interest. The fraud allegations were ultimately withdrawn, and the matter
was resolved with a $53,000 payment from the facility.
First American Title Co. v. Weinstein, et al. Represented
plaintiff in a commercial case involving extensive electronic billing data and
documentation. Prevailed on summary judgment resulting in a $550,000 settlement
to the plaintiff.
