Class Action Settlement - Nursing Facility Medicaid Payments (Case Mix Index)

SEATTLE (September 2006) – Inslee Best is pleased to announce that it has obtained a favorable settlement in a class action challenging the Department of Social and Health Services' calculation of the Medicaid average case mix index for each nursing facility participating in the state of Washington's Medicaid payment system. The settlement includes a $15 million lump-sum payment to the Class (the "Settlement Fund"), together with prospective relief. The prospective relief involves a modification of the process used to determine Medicaid eligibility to more accurately determine which persons residing in nursing facilities are eligible to receive Medicaid benefits. The settlement has been approved by the Court. It is anticipated that the Settlement Fund will be distributed to the Class beginning on or around September 15, 2006. John F.
